Survey of CA Shared Mobility Device Insurance Experience
Survey of California Shared Mobility Device Insurance Experience - Due November 6, 2026
Pursuant to Assembly Bill 371 (Jones-Sawyer), the California Department of Insurance (CDI) is conducting a study pursuant to California Civil Code Section 2505.5 concerning insurance coverage requirements applicable to Shared Mobility Devices that are made available to the public by a Shared Mobility Service Provider for shared use and transportation in exchange for financial compensation via a digital application or other electronic or digital platform, including but not limited to electrically motorized boards, motorized scooters, and class 3 electric bicycles. The purpose of this survey is to collect information regarding insurance coverage, claims experience, and related insurance arrangements during the reporting period from January 1, 2024 to December 31, 2025 to assist CDI in evaluating the appropriateness of the coverage requirements established under Civil Code Section 2505. Insurance companies are requested to provide complete and accurate information in accordance with the instructions. The results of this study will be reported to the Legislature by December 31, 2026.
- All Shared Mobility Service Providers must maintain commercial general liability insurance coverage with an admitted insurer, or a non-admitted insurer with limits not less than one million dollars ($1,000,000) for each occurrence for bodily injury or property damage, including contractual liability, personal injury, and product liability and completed operations, and not less than five million dollars ($5,000,000) aggregate for all occurrences during the policy period.
- Starting July 1, 2023, a Shared Mobility Service Provider was further required to offer or make available, or to confirm a user of a Shared Mobility Device maintains, $10,000 of coverage for any bodily injury or death suffered by a pedestrian in any one accident when the injury or death involves, in whole or in part, the negligent conduct of the Shared Mobility Device user, and $1,000 of coverage for any property damage to an assistive technology device.
To meet this Legislative requirement, CDI is issuing this data survey to all California admitted and non-admitted insurers. Insurers that did not offer this specific type of insurance to the users or providers of Shared Mobility Devices will be able to simply check off the appropriate box on the Signature Page, sign, and return via e-mail a scanned copy as they are exempt from completing the remainder of the survey.
Who is Required to Report?
- All property & casualty companies (regardless of their licensing status in California) that have experience in California in providing the Shared Mobility Device insurance to either the providers or their users of Shared Mobility Devices must submit their report to us according to the General Instructions.
- Penalties for Non-Compliance: Companies that fail to submit the Signature Page, Questionnaire, and the Data Collection Workbooks (if applicable) by the requested due date will be considered in non-compliance with California Insurance Code (CIC) Section 700(c) and will be referred to the Department's Legal Division for further action.
