Policyholder Info List 1

The Holocaust Victim Insurance Relief Act (HVIRA) (California Insurance Code Sections 13800 et. seq.) would have required that California insurers provide the Department of Insurance with Holocaust era policyholder information on policies they wrote or their affiliates wrote in Europe between 1920 and 1945. In March 2000, approximately 100 insurers sued the Department arguing that the statute was unconstitutional. On June 23, 2003, in a 5-4 decision, the United States Supreme Court found the statute to be unconstitutional.

Accordingly, as the Department was unable to enforce the statute, the policyholder list published here as List 1 are those names that insurers submitted voluntarily, together with additional names culled from European archives.

List 1 contains policyholder information from the following insurers: AXA, Dutch insurers that are members of the Dutch Insurance Association (Sjoa), and Mutual of New York. The list also contains policyholder names from additional insurance companies, found in European archives. These names were located by a private research company in archives in Italy and Germany, and are denoted on this list with an asterisk (*). The private research company is out of business and will no longer make the supporting documentation available to the potential claimants. The California Department of Insurance does not have any supporting documentation.

Please note that the lack of words under the columns "Current Status" and/or "Distribution of Proceeds" or anywhere else on this chart, does not imply that the policy remains unpaid. Rather, such lack of entry in listing means that the Department does not have the information. Much of the information on this list was reconstructed from fragmentary documentation that may suggest the existence of a policy. However, not all names represent actual policies. For names marked with an asterisk, contact Beverly Brand at the California Department of Insurance for further information as to how to submit a claim or inquiry.

The time to make a claim through the International Commission on Holocaust Era Insurance Claims (ICHEIC) ended December 31, 2003. However, all ICHEIC member insurers have agreed to continue to process claims that they receive directly.
