Workers' Compensation Insurance Rating Bureau (WCIRB)
Questions or Complaints about Experience Modifications or Classification Disputes. The WCIRB is an insurer association that tabulates workers' compensation industry experience for use in proposing advisory pure premium rates. The WCIRB also develops the standard classification system and manages the experience rating plan which calculates the experience modification for employers that are eligible for ex-mods. Employers with questions or complaints about either their experience modification or classification assignment, may visit the Workers' Compensation Insurance Rating Bureau website and select the "Employers" tab, or the "Answer Center" tab. Also, a policyholder ombudsman is available to assist employers with experience rating and classification questions or problems. The WCIRB may be contacted by telephone at (415)777-0777.
Workers' Compensation Appeals
Employers who have filed complaints with their insurer or with the WCIRB over an issue related to the determination of rates, the experience modification, or the classification assignment, and are aggrieved by the response and continue to dispute it in good faith, or where the dispute involves the interpretation of the applicable regulations or the application of filed rates to their policy, those employers may file an appeal with the Administrative Hearing Bureau at the Department of Insurance. The procedural regulations are contained in Title 10, California Code of Regulations, §2509.40.
