Adoption of Amended Regulations Pertaining to Document Submission and Approval Procedures and Fees File Nos. RH-350 & RH-351 February 11, 1997


This is to advise you that the Insurance Commissioner has adopted permanent changes in his regulations pertaining to document submission and approval procedures and policy approval fees. These changes affect Title 10, California Code of Regulations, Chapter 5, Subchapter 2, Article 1.

Changes Affecting Document Submission and Approval Procedures:

(*)  The amendments pertaining to document submission and approval
     procedures apply to filings of disability (including
     "health"), group, credit and variable life; variable annuity;
     and worker's compensation policy forms.

(*)  The amendments are substantively the same as those proposed in
     the "Notice of Proposed Changes in the Insurance
     Commissioner's Regulations Pertaining to Policy Form Document
     Submission and Approval Procedures . . .", File No. RH-351,
     dated August 8, 1996, except that "Initial" has been inserted
     at the beginning of the last sentence of amended 2214(d).

(*)  The amendments apply to filings of the above types of policy
     forms received on or after March 13, 1997.


Changes Affecting Policy Approval Fees:

(*)  The amendments make permanent, with some changes, the
     emergency regulations promulgated effective September 2, 1996,
     (File No. RH-350), pertaining to policy approval fees
     applicable to filings of disability (including "health"),
     group, credit and variable life, variable annuity; and
     worker's compensation policy forms, annuity contracts of
     grants and annuities societies, motor club service contracts,
     powers of attorney of reciprocal or inter-insurance exchanges,
     and articles of incorporation, constitutions and by-laws of
     fraternal benefit societies.

(*)  The amendments are substantively the same as those proposed in
     the "Amendments to Title 10, Chapter 5, Subchapter 2,
     California Code of Regulations, Pertaining to Policy Approval
     Fees, Notice of Changed Text", dated October 29, 1996.

(*)  The permanent amendments become effective on March 13, 1997;
     until then, the cited emergency regulations remain in effect.

We encourage those who do not need copies of the amended regulations immediately to await their normal publication, especially as they differ so little from those already released in their proposed or emergency forms. However, we have a limited supply of hard copies of the new regulations for those who need them as soon as possible. Please reference "Adopted Regulations for RH-350 & 351" when ordering. We will not honor requests for multiple copies.
