Annual and Quarterly Statement Filings

TO:  All Insurers Admitted to do Business in California and Other Interested Persons

SUBJECT: Annual and Quarterly Statement Filings

The purpose of this Notice is to advise you that all Annual and Quarterly Statement filings required by Section 900 & Sections 931 and 934 of the California Insurance Code (CIC) shall be submitted on the forms for those statements promulgated by the National Association of Insurance Commissioners ("NAIC").  All filings shall be completed in accordance with the instructions contained in the NAIC Annual Statement Instructions and Accounting Practices and Procedures Manual unless such instructions and requirements conflict with California laws, regulations, or instructions governing financial statement reporting, in which case those laws, regulations, and instructions shall prevail.  The Annual and Quarterly Statement must be executed and verified as provided in Sections 903 and 903.5 of the CIC.

Companies that fail to make a timely and complete filing with the California Department Insurance are subject to the assessment of late filing fees pursuant to Section 924 of the CIC.  Companies that fail to make a complete and timely filing with the NAIC are subject to the penalties prescribed by Section 934 of the CIC.

Copies of Annual and Quarterly Statement instructions, checklists, and related documents are no longer being mailed to companies, but instead are being made available on the California Department of Insurance Website.
