Insurance Commissioner Dave Jones Announces Arrest Of Los Angeles County Insurance Agency Owner For Identity Theft
Owner alleged to have stolen former employee's identity

Insurance Commissioner Dave Jones today announced that Ilyas Afzali, 27, of Alta Loma, was arrested on three felony counts for violating Penal Code section 529, False Impersonation, Penal Code Section 530.5(a), Identity Theft and Penal Code Section 115(a), procuring or offering a false or forged instrument to a government agency. Bail has been set at $50,000. If convicted on all counts, Afzali could face a maximum sentence of four years and eight months in state prison.

According to California Department of Insurance (CDI) Investigators, a complaint was received from the California Public Utilities Commission (PUC) against Capitol West Insurance Services Corporation, which is owned and managed by Afzali, alleging that certificates of insurance were illegally being produced, signed and submitted to the PUC by one of Capital West's employees. According to California law, the certificates are to be issued by an insurance company and submitted directly to the PUC.

The investigation revealed that the employee whose signature appeared on the forms was employed by Capitol West from early 2005 through approximately the fall of 2008. The certificates of insurance, purportedly containing the employee's signatures, were submitted to the PUC on behalf of Capital West's insureds between 2009 and 2010. Investigators interviewed the former employee and determined that at the time of the actions in question; the employee was no longer employed by Capitol West.

Investigators also discovered that the former employee's identity and personal information had been compromised. It is alleged that Afzali was involved in getting his former employee's insurance license renewed without her knowledge or authorization. The former employee told investigators that she believed that her license had expired in 2009. The employee stated that she had no idea that her license had been renewed with CDI. Afzali is the brother of former Capital West owner, Aaron Afzali, who previously had his CDI license revoked in 2006 due to falsifying documents.

This case was investigated by CDI's Los Angeles Investigation Division and is being prosecuted by the Los Angeles County District Attorney's Office.
