Guide to Medicare Supplement

Circular MSRG-2013

The purpose of the Medicare Supplement Rate Guide (MSRG) 2013 informational web page is to provide the reporting requirements, due dates, and related information needed to complete and satisfy your company's reporting obligations pursuant to California Insurance Code (CIC) §10192.20 (d) and Health & Safety Code § 1346 & 1384. The MSRG 2013 data call notification will be circulated to companies under the jurisdiction of both the California Department of Insurance (CDI) and the California Department of Managed Health Care (DMHC). Important Information

  1. The Medicare Improvements for Patients and Providers Act of 2008 required all states to adopt by September 24, 2009 certain modernization changes to Medicare supplement policies made in a specified model law developed by the National Association of Insurance Commissioners.
  2. Effective June 01, 2010 certain Medicare supplement plans will no longer be sold (ex. E, H, I and J) while others will be added (M and N). Certain benefits have been added and others deleted. Please visit CDI's Medicare Supplement Insurance for more information.
  3. Please make sure that you read and review the MSRG 2013 Statistical Plan, Acknowledgement Form, and Data Workbook. The MSRG 2013 documents have been updated and revised to be in compliance with CIC § 10140.2 (a) and (b), as well as, recommendations by CDI stakeholders. Companies who do not complete and submit the new and revised MSRG 2013 documents and/or follow the directions outlined in the MSRG 2013 Statistical Plan may be put in resubmission.
  4. Company Filing Status: MSRG 2013 Acknowledgement Form (new and revised) - All active Class 6 (Disability lines) licensees in California will be sent a Circular notification.

NOTE: On the Acknowledgement Form, please use the drop-down list of company names to populate the "Company Name" field. The NAIC or DMHC number will auto-populate once you select your company name. Please review and follow the instructions outlined in the MSRG 2013 Statistical Plan.

  1. Companies who will be filing: All insurers offering Medicare supplement insurance and Medicare supplement contracts (Class 6, Disability lines) in California, and under the jurisdiction of the CDI, as well as all full service health plan providers, under the jurisdiction of the DMHC, who are licensed to provide Medicare supplement coverage. Companies who fall under this category, must submit to CDI by the July 19, 2013 due date, the new and revised MSRG 2013 Acknowledgement Form, Data Workbook, and Affidavit.
  2. Companies who do not have experience to report: Companies Not Currently Offering Medicare Supplement insurance in California Do Not need to complete the Data Workbook and Affidavit. Complete and submit the new and revised Acknowledgement Form by May 31, 2013 if your company has determined that it has no experience ("not filing") to report to this data call. Please include in the "No Experience/Other Explanation" a brief summary of your company's Medicare Supplement "no experience" status. For example, your company may enter that "this company has an active Class 6 license in California, but has never sold or maintained any Medicare Supplement business."
  3. Companies who do not have experience to report in 2013, but have in-force Medicare Supplement business and /or active policies: Companies Not Currently Offering Medicare supplement insurance by the Fall Open Enrollment period (October 2013) in California DO NOT need to complete the Data Workbook and Affidavit. If your company falls under this category, please do the following or contact Joyce Tebangin or Dairyn Valencia.
  • Complete and submit the new and revised Acknowledgement Form by May 31, 2013 if your company has determined that it has no experience ("not filing") in 2013. Please include in the "No Experience/Other Explanation" a brief summary of your company's Medicare Supplement "no experience" status.
  • Complete and mail a formal letter on letterhead along with a company official signature that your company either has stopped writing and/or has withdrawn its Medicare Supplement insurance business in California.
  1. MSRG 2013 Data Workbook (new and revised): Premiums provided are to be as of September 1, 2013. Your company's reported premiums should be the current rates available by the Fall Medicare Annual Open Enrollment (October 2013). Rates provided should be approved rates. If not approved by the time of the data submission then submit the most current approved rates. Each "Sample Rates and Policy Information" worksheet has ten (10) tables available for your company's data entry. If you need more than ten tables to report all of your Medicare Supplement rates and policy information, please contact Joyce Tebangin or Dairyn Valencia. Please review and follow the instructions outlined in the MSRG 2013 Statistical Plan.

Regulatory Authority

This data call applies to all companies currently offering or maintaining existing business in Medicare Supplement Insurance in California.

The Medicare Supplement Rate Guide is a mandatory reporting requirement pursuant to California Insurance Code Section 10192.20(d) and California Health & Safety Code Sections 1346(a)(3)(5) and 1384(d). The links provided below will allow you to download ("Save" or "Save As") the instructions and forms. When you select the link on any of the documents below, please "Save" or "Save as" to your company's computer. Submit Forms and Data

Document Upload Procedure -

Submitting the completed MSRG documents to CDI. To prevent delays in processing your company's documents, it is important that you answer the questions completely and correctly (i.e. correct Reporting Year, data call, etc.). If your company experiences problems using the Document Upload Procedure, please provide an e-mail explanation and submit your MSRG documents to Statreports@insurance.ca.gov.

Steps:

  1. Once you have completed your forms and want to begin the submission process, click "Submit Forms and Data". This link will open the secured Document Upload Program.
  2. Select Your Company's Name: The Document Upload Program will begin by asking you to enter your company's name. Select your company's name from the drop-down list provided on the Webpage.
  3. Provide Contact Information: Provide the name and e-mail address for the Data Call Contact. The data call contact is person responsible for answering any questions regarding the information reported by your company.
  4. Reporting Year: For MSRG 2013, please select "2013".
  5. Filing as a Group is Not Allowed: For the MSRG, companies may only report on an individual basis. For the MSRG 2013, you may only select "No".
  6. Select Report Type: From the drop-down list of values, select the Medicare Supplement Rate Guide.
  7. Once you have finished completing the contact and data call information, Please Select "Submit".
  8. Uploading the File: Select the "Browse" Button: After you have entered the contact information and the data call (report type) you are filing under, use the "Browse" button to search for the file you would like to submit. The Document Upload Program will only allow a single upload per transaction.
  9. Submit Data: After you have selected the file you would like to submit, Select on the "Submit" button. This will upload your company's file to CDI's secure server.
    • "Are you submitting another file for the Same Company and Data Call (as listed above)? If "Yes", please select the "Update" button."
    • "Are you submitting for a Different Company and/or Different Data Call (other than what is listed above)? If "Yes", please click on the Back to Search button and repeat the submission process for the new data call/company."

Frequently Asked Technical Issue: Once you have your Internet browser open (Internet Explorer version 7.0 and up is preferred), please go to Tools/Internet Options/Advanced Make sure that the "Enable native XML HTTP support" is check marked.
