CLTA (California Land Title Association) Form 100 (1996) Restrictions, Encroachments, & Minerals
Provides an ALTA (American Land Title Association) lender with affirmative insurance concerning covenants, conditions and restrictions, encroachments, easements, and mineral developments.
CLTA Form 100.12 (1996) CC&R's, Right of Reversion
Provides ALTA and CLTA owner and lender with specific insurance concerning the enforceability of a reverter provision contained in CC&R's.
Insures that a reverter, right of re-entry or power of termination provision contained in CC&R's (Covenants, Conditions & Restrictions) is not enforceable and will not result in a loss.
CLTA Form 103.5 (1993) Water Rights, Surface Damage
Provides an ALTA owner or lender with insurance against loss due to damage to existing improvements on the land resulting from the use of the surface of the land in connection with the extraction or development of water, either excepted from the legal description of the property or shown as a reservation (exception).
CLTA Form 110.9 (1987) Environment Lien
Provides an insured owner or lender against the loss or damage sustained by reason or lack of priority of the lien of the Insured mortgage over:
- any environmental protection lien which, at Date of Policy, is recorded in those records established under states statues at Date of Policy for the purpose of the imparting constructive notice of matters relating to real property to purchasers for value and without knowledge, or filed in the records of the clerk of the United States district court of the district in which the land is located, except as set forth in Schedule B; or
- any environment protect lien provided for by any state statute in effect at Date of Policy, except environmental protection liens provided for by the following state states
CLTA Form 116 (1996) Designation of Improvement, Address
Provides an ALTA lender, at time of policy issuance, with assurances that:
- there is located on the land a designated improvement (i.e., a residence)
- said improvement has been assessed and is known as a particular street address; and
- the policy map shows the correct location and dimensions of said land according to the public records.
CLTA Form 116.2 (1996) Designation of Improvement, Address, Condominiums
Provides an insured owner or lender, at the time of policy issuance, with assurance that:
- the dimensions of the exterior boundary of the common area referred to in the policy description are correctly shown on a designated map of record;
- the elements referred to in the policy description as comprising the insured condominium include specified improvements; and
- said improvements have been assessed, and are known as, a particular street address.
